Terms & Liability (read before submitting)

By submitting this request and/or booking service, you agree to Violet Crest Automotive's full Terms & Liability. Quotes are estimates only. You assume responsibility for vehicle condition, site access, and payment. Our liability is strictly limited as described below.

1. Agreement, parties & acceptance

  • These Terms & Liability (“Terms”) govern all quotes, consultations, bookings, and services provided by Violet Crest Automotive, doing business as Violet Crest Auto (“Company,” “we,” “us,” or “our”), including through our website, phone, text, email, or any other channel.
  • By submitting this form, checking the acceptance box, booking an appointment, allowing us to perform work, or paying for services, you (“Client,” “you,” or “your”) agree to these Terms on behalf of yourself and any vehicle owner, lessee, insurer, or other interested party.
  • You represent that you are at least 18 years old, have legal authority to request service for the vehicle, and have authority to bind the vehicle owner to these Terms.
  • If you do not agree to every provision, do not submit this form or book service.
  • These Terms apply to all services, including detailing, interior restoration, paint enhancement, paint correction, ceramic coating, add-ons, maintenance visits, and any future services we offer.

2. Quotes, estimates, pricing & payment

  • All website prices, menu prices, and online quotes are starting estimates only — not binding final prices.
  • Final pricing is determined after review of your photos, vehicle inspection on site, vehicle size, trim level, contamination level, paint condition, scope of work, travel, and any add-ons or corrections required.
  • We may revise pricing before work begins if the vehicle condition, scope, or access differs materially from what was represented.
  • No work beyond the agreed scope will be performed without your approval. Approved additional work may increase the total price.
  • Payment is due in full upon completion of services unless we expressly agree otherwise in writing.
  • We accept payment methods disclosed at the time of service. Declined, reversed, or insufficient payments do not relieve your obligation to pay the full amount due.
  • You are responsible for all bank fees, chargeback fees, collection costs, and reasonable attorney fees incurred due to non-payment or disputed charges pursued in bad faith.
  • Promotions, discounts, or quoted prices may not be combined unless expressly authorized in writing.
  • Gratuity is optional and never required.

3. Scheduling, cancellation, rescheduling & no-shows

  • Appointments are subject to availability, weather, equipment, staffing, and safe working conditions.
  • You must provide accurate contact information and respond promptly to scheduling messages.
  • Cancellations or reschedules require at least 24 hours' notice before the scheduled start time.
  • Late cancellations, reschedules, or no-shows may incur a fee up to 50% of the scheduled service price or a minimum service call fee, whichever is greater, at our sole discretion.
  • If we arrive and cannot perform service due to your unavailability, incorrect address, denied access, unsafe conditions, or misrepresentation of the vehicle or scope, a trip fee or cancellation fee may apply.
  • We may reschedule or cancel appointments for weather, safety, equipment failure, emergencies, or other circumstances beyond our control without liability.

4. Vehicle access, work area & client responsibilities

  • You must provide safe, legal, and reasonable access to the vehicle and a suitable work area with adequate lighting, ventilation, and space to open doors, hood, and trunk as needed.
  • You are responsible for ensuring the service location complies with HOA, landlord, municipal, parking, and property rules. Any fines, towing, or penalties arising from the location are your responsibility.
  • You must disclose low clearance garages, steep driveways, uneven surfaces, limited water access, electrical limitations, or any condition that may affect service or safety.
  • The vehicle must be legally parked and accessible for the entire scheduled service window.
  • You must remove personal belongings you do not want handled. We are not responsible for items left in the vehicle.
  • You must disclose aftermarket parts, wraps, PPF, delicate trim, modified surfaces, fresh paint, repaints, vinyl, decals, cracked glass, loose trim, open recalls, mechanical issues, leaks, or any special care requirements before service.
  • Children, pets, and bystanders must be kept at a safe distance during service. You are responsible for supervising your property and guests.
  • We may refuse, pause, or stop service if conditions are unsafe, unlawful, abusive, or materially different from what was disclosed.

5. Inspection, documentation & pre-existing conditions

  • You agree that vehicles are inspected before, during, and after service to the extent reasonably possible in a mobile setting.
  • You acknowledge that pre-existing damage may include, without limitation: scratches, swirls, holograms, oxidation, etching, water spots, paint failure, clear coat failure, rust, dents, chips, cracks, trim fading, interior wear, stains, burns, tears, odors, mold, biohazards, and prior poor repair work.
  • We are not responsible for any pre-existing condition, whether visible or hidden, disclosed or undisclosed, unless we expressly assume responsibility in a signed written document.
  • Photos, videos, and notes taken before or after service are for documentation, quoting, quality control, and dispute prevention. You consent to this documentation.
  • If you believe damage occurred during service, you must notify us in writing within 24 hours of service completion with supporting photos. Failure to report promptly may waive your ability to pursue a claim.
  • Normal detailing processes may reveal or accentuate pre-existing defects. This is not considered new damage caused by us.

6. Detailing & interior services

  • Cleaning results depend on material type, age, prior neglect, dye stability, manufacturer finishes, and contamination severity.
  • We do not guarantee complete removal of all stains, odors, pet hair, smoke, mold, bodily fluids, dye transfer, ink, tree sap, tar, or embedded contamination.
  • Steam, extraction, brushing, and agitation carry inherent risks on delicate, aged, or damaged materials. Shrinkage, dye bleed, texture change, or seam separation may occur on neglected or compromised surfaces.
  • We are not responsible for malfunctioning electronics, window regulators, seat mechanisms, or interior components that fail due to age, moisture exposure, or pre-existing defect.
  • Odor treatment reduces odors but does not guarantee permanent elimination without source removal or mechanical repair.
  • Biohazard, mold, pest, or extreme contamination may be declined or require specialized treatment at additional cost.

7. Paint enhancement, correction & ceramic coating

  • Paint services are corrective and aesthetic, not structural. We do not guarantee removal of all defects, scratches, or imperfections.
  • Results vary based on paint type, hardness, thickness, prior repairs, factory orange peel, and safe working limits measured by paint thickness when applicable.
  • We will not exceed safe correction limits. Some defects may remain by design to protect your paint.
  • Machine polishing inherently removes microscopic amounts of clear coat. You assume this risk when authorizing correction or coating prep.
  • Ceramic coating and sealants improve gloss and protection but do not make paint scratch-proof, chip-proof, or maintenance-free.
  • Coating performance depends on cure time, weather, aftercare, washing methods, and environmental exposure. You must follow all aftercare instructions provided.
  • Improper aftercare, automatic car washes with brushes, harsh chemicals, or failure to maintain the coating voids any goodwill remedy.
  • We are not responsible for manufacturer warranty issues, recall items, repaints, thin clear coat, or paint failure unrelated to our workmanship.
  • Cure times, rain exposure, and garage requirements will be communicated when applicable. You are responsible for protecting the vehicle during cure.

8. Add-ons, chemicals, equipment & mechanical areas

  • Engine bay, headlight restoration, and specialty add-ons carry inherent risks on brittle plastics, aged seals, oxidized lenses, and prior repairs.
  • We are not responsible for triggering check engine lights, sensor issues, or latent electrical problems exposed during cleaning unless directly caused by our negligence.
  • You authorize use of professional-grade cleaners, solvents, degreasers, dressings, polishes, compounds, coatings, and equipment appropriate to the service.
  • You must disclose chemical sensitivities, allergies, or restrictions before service. We are not liable for reactions due to undisclosed sensitivities.

9. Keys, security, theft & personal property

  • If you provide keys or remote access, you authorize us to move the vehicle only as reasonably necessary within the service area.
  • We exercise reasonable care but are not an insurer of your vehicle or contents. We are not responsible for theft, loss, vandalism, or third-party acts while the vehicle is accessible.
  • Remove cash, documents, firearms, medications, electronics, and valuables before service. We are not responsible for lost, stolen, or damaged personal property left in the vehicle.
  • We are not responsible for aftermarket security systems, dash cams, or alarms triggered during service.

10. Disclaimer of warranties

  • EXCEPT AS EXPRESSLY STATED IN A SIGNED WRITTEN AGREEMENT, ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • NO VERBAL STATEMENTS, SOCIAL MEDIA, REVIEWS, OR MARKETING MATERIALS CREATE A WARRANTY.
  • Any remedy for dissatisfaction is limited to our discretion and may include re-performance of the specific area of concern within a reasonable time — not a refund unless required by law.

11. Limitation of liability

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO ANY SERVICE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
  • IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF USE, LOSS OF VALUE, LOSS OF INCOME, DIMINUTION IN VALUE, EMOTIONAL DISTRESS, OR RENTAL CAR COSTS.
  • WE ARE NOT LIABLE FOR DELAYS, CANCELLATIONS, OR FAILURE TO PERFORM DUE TO WEATHER, TRAFFIC, SUPPLY ISSUES, EQUIPMENT FAILURE, LABOR SHORTAGE, OR OTHER CAUSES BEYOND OUR REASONABLE CONTROL.
  • Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by applicable law.

12. Indemnification

  • You agree to defend, indemnify, and hold harmless Violet Crest Automotive, its owners, operators, employees, contractors, and agents from and against any claims, damages, losses, liabilities, fines, penalties, costs, and expenses (including reasonable attorney fees) arising out of or related to:
  • (a) your breach of these Terms;
  • (b) your misrepresentation of the vehicle, site, or scope;
  • (c) your failure to obtain permissions for the service location;
  • (d) pre-existing conditions or undisclosed risks;
  • (e) personal property left in the vehicle;
  • (f) your instructions that deviate from our professional recommendation;
  • (g) third-party claims related to the vehicle or service location while you arranged access.

13. Chargebacks, disputes & collections

  • You agree to contact us first to resolve any billing concern before initiating a chargeback or payment dispute.
  • Filing a chargeback or dispute in bad faith after receiving services may result in collection action and recovery of fees and costs.
  • You consent to us providing service documentation, photos, messages, and these Terms to payment processors or courts to contest improper disputes.

14. Communications, photos & marketing

  • You consent to be contacted by phone, text, and email regarding quotes, scheduling, service updates, and billing at the contact information you provide.
  • Message and data rates may apply. You may opt out of marketing messages but not service-related communications for active bookings.
  • Unless you opt out in writing before service, you grant us a non-exclusive license to use before/after photos or video of your vehicle (without license plates or personal identifiers where practicable) for portfolio, website, and marketing purposes.

15. Right to refuse service

  • We reserve the right to refuse, discontinue, or terminate service to any client at any time for safety, non-payment, abusive conduct, misrepresentation, unlawful requests, biohazards, or any reason permitted by law.
  • Refused or terminated service does not waive amounts due for work already performed, trip fees, or cancellation fees.

16. Force majeure

  • We are not liable for failure or delay in performance caused by events beyond our reasonable control, including severe weather, natural disasters, power outages, government orders, pandemics, supply shortages, civil unrest, or transportation disruptions.

17. Governing law, venue & dispute resolution

  • These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules.
  • Any dispute arising out of these Terms or our services shall be brought exclusively in the state or federal courts located in or serving Camden County, New Jersey, and you consent to personal jurisdiction in those courts.
  • You waive any objection to venue or forum non conveniens in those courts to the extent permitted by law.
  • Nothing prevents us from seeking injunctive relief or collections in any jurisdiction where you or assets are located.

18. Severability, entire agreement & changes

  • If any provision is held invalid or unenforceable, the remaining provisions remain in full force.
  • These Terms constitute the entire agreement regarding liability and service conditions unless superseded by a signed written agreement for a specific job.
  • We may update these Terms at any time. The version in effect at the time of your acceptance or booking applies.
